AFFIDAVITS OF THE ALDRIDGE BROTHERS, David & Darryl

AFFIDAVIT OF DAVID ALDRIDGE
(Petitioner's Exhibit #27 - Affidavit - D. Aldridge 12/29/1995)

COUNTY OF COBB
STATE OF GEORGIA

I, David Aldridge, hereby depose, swear, and state:

1. I owned and operated a real estate business called Middle Georgia Woodlands, Inc. in Atlanta, Georgia, from 1983 to 1992. I was born and raised in the Atlanta area. Middle Georgia Woodlands sold timberland in central Georgia, including Putnam County at one time. For a period of time in the late 1980ís, Middle Georgia Woodlands, Inc. began a development called Sebastionís Cove, at Lake Oconee in Putnam County.

2. I met Wallace Fugate when I was working on the Sebastionís Cove project in Putnam County in 1987 and 1988. Mrs. Patti Fugate was a reporter for the Eatonton paper who came to interview me about the development for an article in the paper. Patti Fugate mentioned that her husband needed a job. I offered Mr. Fugate a ob as a security guard. Mr. Fugate did that job for a while, but he became unhappy because he wanted to get involved in the building work. I eventually gave Mr. Fugate several jobs working on the cabins. Mr. and Mrs. Fugate worked together on the houses sometimes. I saw Mr. Fugate once a week on Fridays, and I talked to him frequently on the phone about work.

3. Wallace Fugate was a hard worker His work was always complete. Mr. Fugate was a detail man. He was very serious about the work we gave him. Mr. Fugate was always at work early, and he always left late. Hew as a good worker for me because we needed someone just like that to work on the houses. Mr. Fugate liked to use his hands, and he was very good with tools. He did a great deal of carpentry on the houses. Mr. Fugate did most of the work on two of our cabins.

4. Mr. Fugate was ambitious about pursuing jobs. He came to us asking for more work, but the development was taken over by Emmitt Barnes from Macon, Georgia, and we didnít have any more work.

5. When I knew Mr. Fugate, he and Patti Fugate seemed to get along fine. I used to see their son Mark when I was at the development. Markís bus used to drop him off at Sebastionís Cove after school, and he would hang around while his parents finished working. I saw Mr. Fugate get mad sometimes but never lose his temper.

6. I was never contacted by anyone about what I know of Wallace Fugate before his trial.

Under the pains and penalties of perjury, I hereby swear that the foregoing statement is true and accurate.

AFFIDAVIT OF DARRYL ALDRIDGE
(Petitioner's Exhibit #28 - Affidavit - D. Aldridge 12/29/1995)

COUNTY OF COBB
STATE OF GEORGIA

I, Darryl Aldridge, hereby depose, swear and state:

1. My name is Darryl Aldridge. I was born and raised in the Atlanta area. I know Wallace Fugate because I was involved during the last 1980ís in the development of a housing development at Sebastionís Cove, by Lake Oconee, in Putnam County.

2. My brother and I hired Mr. Fugate to work on the development. I knew Mr. Fugate and his wife Patti for about two years while we were involved in the Sebastion Cove development.

3. I saw Mr. Fugate roughly two to three times a week at Sebastionís Cove. Most of my contact with Mr. Fugate was one on one.

4. Mr. Fugate was an extremely hard worker. He was ambitious about getting work from us. I used to stay in Putnam County on the weekends working on the development, and I always got there early in the morning. I used to run into Mr. Fugate when I got there. He always got there earlier than I did. Mr. Fugate always came to work early, and he always left late.

5. Mr. Fugate was very good at carpentry. He could do anything with his hands. The houses in the development were log cabins. Mr. Fugate would do all of the carpentry in a house. I remember one house where he did all the hardwood floors, and he built a spiral staircase. Mr. Fugate knew how to do all the other work, like the electricity, on the cabins as well. He did most of the work on three of our cabins.

6. Mr. Fugate did things beyond the demands of his job and suggested projects and work. He once got an idea that he could fix up the entrance to the Sebastion Cove development. He and Patti went out there and dressed up the front entrance. Mr. Fugate built a fence and some flowerboxes, and landscaped the entrance.

7. Mr. Fugate worked a lot on my brother Davidís house. He worked hard, and he was very proud of his work on the house. He wanted to give David something as a housewarming gift. Mr. Fugate carved a plaque for David with his name on it and arranged it on the mantle in the house where David could see it.

8. I was never contacted by anyone with regard to providing information about Mr. Fugate prior to his trial.

Under the pains and penalties of perjury, I hereby swear that this statement is true and accurate.
